Terms of Service

1. Acceptance of Terms

By accessing or using GENER8 ("the Service", "we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These terms apply to all users, visitors, and others who access or use GENER8. You must be at least 13 years of age to use the Service.

2. Description of Service

GENER8 is an AI-powered social media content generation platform that helps users create, manage, and schedule posts across multiple platforms including Instagram, TikTok, Facebook, YouTube, and Email. The Service uses artificial intelligence (Anthropic's Claude) to generate content based on user-provided briefs and preferences.

3. User Accounts

You must create an account to use GENER8. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete information
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate accounts that violate these terms.

4. AI-Generated Content

GENER8 uses Anthropic's Claude AI to generate content. By using the Service, you acknowledge and agree that:

  • AI-generated content may not always be accurate, appropriate, or suitable for your needs.
  • You are solely responsible for reviewing, editing, and approving all content before publishing.
  • You own the final content you publish. GENER8 claims no ownership over your published posts.
  • You grant GENER8 a limited, non-exclusive license to use anonymized, aggregated content patterns to improve the Service.
  • AI-generated content must not be used to create misleading, harmful, defamatory, or deceptive material.

5. Acceptable Use Policy

You agree not to use GENER8 to:

  • Generate spam, misinformation, or deceptive content
  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Harass, threaten, or harm any individual or group
  • Attempt to reverse-engineer, scrape, or extract the underlying AI models or source code
  • Resell, sublicense, or redistribute the Service without express written authorization
  • Use automated bots or scripts to access the Service in a manner that violates these terms

Violation of this policy may result in immediate account termination without refund.

6. Social Media Platform Compliance

When connecting social media accounts to GENER8, you agree to comply with the individual terms of service of each platform (Meta, TikTok, Google/YouTube). GENER8 is not responsible for any violations of third-party platform policies resulting from your use of the Service. You are solely responsible for how you use generated content across external platforms.

7. Google Integrations

When you connect a Google account, GENER8 may request access to Google Drive and Google Photos to allow you to import media into your posts. We will only access the data necessary to provide this functionality. Your Google data is not stored on GENER8 servers and is used only for the duration of your session. You may disconnect Google at any time from the Settings page.

8. Payments and Subscriptions

Certain features of GENER8 require a paid subscription. By subscribing, you agree to the following:

  • All payments are processed securely through Stripe. We do not store your card details.
  • Subscription fees are billed in advance on a monthly or annual basis.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Fees are non-refundable except where required by applicable law.
  • We reserve the right to change pricing with 30 days' prior notice.

9. Intellectual Property

The GENER8 platform, brand, logo, and underlying technology are the intellectual property of GENER8 and its licensors. Nothing in these terms grants you any right to use our trademarks, trade names, or brand assets without prior written consent. All rights not expressly granted herein are reserved.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or for any other reason at our sole discretion, with or without notice. You may cancel your account at any time from your Settings page. Upon termination, your right to use the Service ceases immediately.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, GENER8 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, revenue, goodwill, or business opportunities — even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless GENER8 and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in California.

15. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through the Service. Your continued use of GENER8 after changes take effect constitutes your acceptance of the updated terms. We recommend reviewing these terms periodically.
